These Terms and Conditions of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BackPing LLC, doing business as USA Legal Support, USA Family Support, USA Work Options, InjuryDirect Pharmacy, HomeHelper, and PolicyHelper ("Company," "we," "us," or "our"). These Terms govern your access to and use of the websites ("Site"): backping.com, usalegalsupport.com, usafamilysupport.com, usaworkoptions.com, injurydirectpharmacy.com, homehelper.ai, and policyhelper.ai, and any services, content, or functionality offered through the Site.
By accessing the Site or submitting any information, you agree to be bound by these Terms and Conditions of Use, our Privacy Policy, and our E-Sign Disclosure and Consent. If you do not agree, you must cease use of the Site immediately.
The Site is a lead generation and information platform. We provide resources to help users explore service options and connect them with third-party Service Partners ("Service Partners"). BackPing LLC is not itself a Service Partner. We are not an agent for the Service Partners. Any contract for services is strictly between you and the Service Partner. We do not endorse or guarantee the quality, safety, or legality of the services provided.
Pursuant to the E-SIGN Act, you agree that your use of a keypad, mouse, or other device to select an item, button, or icon (such as "I Agree", "Submit", "Find My Pro") constitutes your electronic signature and acceptance as if actually signed by you in writing. You consent to receive all disclosures and notifications from us electronically via the email provided.
By providing your telephone number and clicking the submission button, you are knowingly and voluntarily providing your ESIGN signature and Prior Express Written Consent to receive marketing and informational communications — including calls and text messages — from BackPing LLC and its Service Partners. This consent specifically applies even if your number is registered on a state or national Do Not Call list. You authorize the use of automated technology, Automatic Telephone Dialing Systems (ATDS), prerecorded and/or artificial voice messages, and artificial intelligence-generated voice messaging. Consent is not required to obtain any good or service.
You may revoke consent and opt out of marketing communications at any time by: (1) replying "STOP" to any text message received; (2) emailing contact@backping.com; (3) requesting an opt-out during any live call; or (4) submitting a request through our Opt-Out form.
To the maximum extent permitted by law, BackPing LLC shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the work of a Service Partner or inaccuracies in the service options presented. Our total liability for any claim shall not exceed $100.00 USD.
Phone Number Warranty. By submitting your telephone number, you warrant that you are the primary subscriber or customary user of that number, that you have the authority to provide consent on behalf of that number, and that you are providing your information in good faith and not for the purpose of initiating a legal claim or inducing a technical regulatory violation by BackPing LLC or its Service Partners.
Prohibited Users. Use of this Site is strictly prohibited by any individual or entity that qualifies as a "Serial Litigant," defined as any person or entity that has filed two (2) or more civil actions alleging violations of the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), or any substantially similar state telemarketing or consumer protection law within the preceding ten (10) years. By accessing or using this Site, you represent and warrant that you do not meet this definition.
Indemnification. If you provide a telephone number for which you are not the primary subscriber or customary user, or if you provide any information for the purpose of initiating legal action or trapping the Company or its Service Partners in a regulatory or statutory violation, you agree to indemnify, defend, and hold harmless BackPing LLC and its Service Partners from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from any resulting regulatory, civil, or administrative claims.
Liquidated Damages. You agree that actual damages for violations of the warranties in this section would be difficult to ascertain and that $50,000 per violation is a reasonable estimate of the harm caused. Accordingly, you agree that if you violate any warranty in this section, you shall be liable to BackPing LLC for liquidated damages in the amount of $50,000 per violation, which amount the parties acknowledge is reasonable and not a penalty.
These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Any controversy, claim, or dispute arising out of or related to these Terms and/or the Site (a "Dispute") shall be solely and exclusively resolved according to the procedures set forth in this section.
Informal Resolution. Before initiating arbitration, the parties agree to attempt to resolve any Dispute informally for at least thirty (30) days after written notice of the Dispute is provided to the other party.
Arbitration. The demand for arbitration shall be made within one (1) year from when the aggrieved party knew or should have known of the controversy. Arbitration shall be conducted according to the rules of the American Arbitration Association (AAA), before a single neutral arbitrator, in Denver, Colorado. If the amount in controversy is less than $10,000, the Dispute will be decided on written submissions without a hearing.
Arbitrator Authority & Fees. The arbitrator's decision is final and binding, without option to appeal, and the arbitrator may not award punitive, special, consequential, or indirect damages. Each party is responsible for its own attorneys' fees and costs, regardless of which party prevails, unless the arbitrator determines otherwise.
Class Action Waiver. No Disputes may be arbitrated on a class or representative basis. EACH PARTY IRREVOCABLY WAIVES ANY RIGHT TO JOIN CLAIMS WITH THOSE OF OTHERS IN A CLASS ACTION, CLASS ARBITRATION, OR SIMILAR PROCEDURE, AND WAIVES ANY RIGHT TO A JURY TRIAL.
Governing Law & Venue. Any matter not subject to arbitration is subject to the exclusive jurisdiction of the federal and state courts located in Denver, Colorado.
