When you submit your phone number, we record your consent event, including the date, time, and the specific consent language presented to you at the time of submission, as required by applicable law.
We use your data to fulfill your request for services and to connect you with our network of Service Partners. You acknowledge that BackPing LLC operates as a lead generation business and that we sell, share, or otherwise transfer your personal information to third-party Service Partners for marketing purposes. We do not control how these third parties use your data once shared. Each Service Partner is independently responsible for their own data practices, and we encourage you to review their privacy policies.
When you provide your phone number and check the consent box on any of our submission forms, you are providing your ESIGN signature and prior express written consent to be contacted by BackPing LLC and its Service Partners for marketing purposes by phone, SMS/text, and email, including through the use of automated technology, Automatic Telephone Dialing Systems (ATDS), prerecorded and/or artificial voice messages, and artificial intelligence-generated voice messaging — even if your number is on a National or State Do Not Call list. Consent is not required to obtain any good or service. Message and data rates may apply.
You may revoke consent and opt out of marketing communications at any time by: (1) replying "STOP" to any text message received; (2) emailing contact@backping.com; (3) requesting an opt-out during any live call; or (4) submitting a request through our Opt-Out form.
Use of our Site and submission forms is strictly prohibited by any individual who qualifies as a Serial Litigant, as defined in our Terms and Conditions of Use. By submitting your information, you warrant that you are the primary subscriber or customary user of the phone number provided and that you are doing so in good faith. Submissions made in violation of this warranty may result in indemnification obligations and liquidated damages as set forth in our Terms and Conditions of Use.
We retain your personal information, including consent records, for as long as necessary to fulfill the purposes outlined in this policy, to comply with applicable legal and regulatory requirements, or to defend against legal claims — whichever is longer. Consent records, including TrustedForm certificates and submission timestamps, are retained for a minimum of four (4) years in accordance with TCPA statute of limitations requirements.
Depending on your state of residency, you may have rights under applicable privacy law, including the right to know what personal information we have collected, the right to delete your personal information, the right to correct inaccurate information, and the right to opt out of the sale or sharing of your personal information. To exercise any of these rights, please email contact@backping.com or submit a request through our Opt-Out form. We will respond to verified requests within 45 days as required by applicable law.
Any disputes arising from this Privacy Policy are subject to the mandatory arbitration, class action waiver, and governing law provisions set forth in our Terms and Conditions of Use, which are incorporated herein by reference.
